Firms File Wrongful Death Case Against Wake County Sheriff and Detention Officer

Blue Stephens & Fellers LLP and Jessie A. Jeffers, P.A. announced today that they filed a wrongful death lawsuit in federal court on behalf of the Estate of Shon D. McClain against Wake County Sheriff Donnie Harrison and former Detention Officer Markeith Council.

The complaint alleges that Mr. McClain was killed as the result of unlawful and excessive force when Officer Council struck him in the back and body slammed him twice, causing him to land on his head and suffer a traumatic brain injury and spinal cord injury.  At the time of his death, Mr. Council was a pre-trial detainee who was being held in the Wake County jail on Hammond Road on misdemeanor charges of drinking in public and missing a court date.

On December 12, 2013, a 12-person jury in Wake County found Council guilty of involuntary manslaughter.

The case is pending in the United States District Court for the Eastern District of North Carolina, and will be heard in New Bern.
